Terms of Service

Last updated: October 16, 2026

These terms are an agreement between you and Firebrand Developments LLC ("we", "us"), 150 Mercer St, Unit 1084, Hightstown, New Jersey 08520, USA, for your use of Atomics at atomics.app, its apps, and its API and connectors (the "Service"). By creating an account, buying a plan, or using the Service, you agree to these terms and to our Privacy Policy. If you use Atomics for an organization, you agree on its behalf and confirm you have the authority to do so.

1. Who can use Atomics

You must be at least 13 years old. If you are under 18, a parent or guardian must agree to these terms for you, or your school or organization must, if it gave you your account. The adult or organization that agrees is responsible for your use of Atomics. You must be 18 or older to buy a plan or to sell or pay for items (sections 6 and 7).

You are responsible for your account, for keeping your passphrase, passkeys and access tokens safe, and for everything done with them. Tell us promptly at support@atomics.app if you think someone else has access.

School and organization accounts

A school, district or other organization can give accounts to its students or members. The organization agrees to these terms for those accounts, and confirms it has any consent the law requires, including from parents where needed. It manages who has access and can ask us to delete its users' data. Our Privacy Policy explains how we handle student data. If we have a signed agreement with the organization, such as a student data privacy agreement or an order form, it controls where it differs from these terms.

2. Your content

You own what you put into Atomics: your spaces, files, notes and the rest ("Your Content"). You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit and display Your Content only as needed to run the Service for you and the people you share with. This includes sending it to the AI providers you use, as described in the Privacy Policy. The license ends when you delete the content or your account, except for copies already shared with others or held in backups for a limited time. We do not sell Your Content or use it to train AI models.

You confirm you have the rights to the content you upload and share, and that it does not break the law or anyone else's rights.

3. Sharing and public links

You decide who can see your spaces. A space shared by link can be viewed and edited by anyone who has the link, with no account needed. You are responsible for what you share and with whom. When you add content to someone else's space, the owner controls it from then on.

4. AI features

  • AI output can be wrong, incomplete or offensive. Check it before you rely on it, and do not use it as professional (legal, medical, financial or similar) advice.
  • You are responsible for how you use the output, and for following the usage policies of the model provider you choose.
  • Plans include a monthly amount of AI credits. Unused credits do not roll over or carry cash value. We may change which models are offered.
  • If you add your own provider API key, charges on that key are between you and the provider.

5. Acceptable use

Do not use Atomics to:

  • break the law, or infringe or misappropriate anyone's intellectual property, privacy or publicity rights;
  • store or share child sexual abuse material, content that harasses, threatens or incites violence against people, or non-consensual intimate imagery;
  • send spam or malware, phish, or run scams or fraud;
  • probe, break or bypass our security, access other people's accounts or spaces without permission, or overload the Service;
  • scrape or bulk-harvest the Service, other than through the API and connectors we provide and within their limits;
  • resell or rebrand the Service itself without our written permission.

Business and commercial use of Atomics is welcome, including selling items in your spaces as described in section 7.

6. Plans, billing and cancellation

  • Plans. Atomics has a free plan and paid plans. Current plans, prices and limits are listed on the Plans page. Prices are in US dollars and exclude taxes, which we add where required.
  • Automatic renewal. Paid plans renew automatically at the end of each billing period (weekly, monthly or yearly, as you chose). They are charged to your payment method through Stripe at the current price until you cancel.
  • Lifetime Pro. Lifetime Pro is a single payment for the Pro plan, with no renewal. It lasts for as long as we operate the Service, not for your lifetime or any fixed period. It includes what the Pro plan includes as Pro changes over time, including any move of hosted AI to usage credits. We may stop selling Lifetime Pro at any time; stopping sales does not affect anyone who already bought it. It is personal to your account and cannot be transferred. If you buy it while subscribed to Pro, that subscription is set to end at the close of its current period.
  • Cancelling. You can cancel at any time on the Billing page. Cancellation takes effect at the end of the current period, and you keep your plan until then.
  • Refunds. Payments are not refundable, and we do not refund partial periods, except where the law requires it or we decide otherwise. If you believe you were charged in error, email us within 30 days.
  • Price changes. We will give you at least 30 days' notice of a price change for an existing subscription, and the new price applies from your next renewal after that notice. You can cancel before it does.
  • Downgrades. When a paid plan ends, the free plan's limits apply. If you are over them, you may not be able to add cloud content until you are back within them. Ending a paid plan does not delete your content.
  • Enterprise and quoted plans are governed by these terms together with your order or agreement. Where they conflict, your order or agreement wins.

7. Selling items and crypto payments

Space owners can charge for access to items, paid in USDC on a public blockchain. If you sell, you are the seller: you are responsible for what you sell, how you describe it, refunds to your buyers, and any taxes. We are not a party to the sale. Blockchain payments are final and cannot be reversed by us. You are responsible for your wallet, keys and network fees, and for checking the wallet addresses you use. Crypto values and networks can change without warning.

8. Selling apps on the Marketplace

Makers can list an app from App Studio on the Marketplace for a one-time price. We sell it for you: we take the payment, keep our share and the card fee, and pay you the rest through our payment provider once you have set up where you are paid. Our share, and any listing fee, are shown in App Studio. Each sale is held for 14 days for refunds, then paid on the 1st of the following month, and an amount under $10 carries to the next one. A refund after you were paid comes off your next payout.

We may hold a payout, or part of one, while we look into a refund, a dispute, a breach of these terms or a request from our payment provider, and for as long as the provider holds our account. Money held this way stays owed to you and is paid when the hold ends, less any refunds it has to cover.

We may change the payment provider that pays you. If we do, we will tell you first, and you may need to set up where you are paid again with the new provider before your next payout. What you have earned is kept on our own records, so none of it is lost in the move.

9. API, connectors and third-party services

You can connect outside apps and AI agents to your account, or create personal access tokens. Whatever they do with the access you grant counts as your use of the Service. You can revoke access from your account page at any time. Third-party services, including AI providers, embedded sites and wallets, are governed by their own terms. We are not responsible for them.

10. Our property

The Service, including its software, design and the Atomics name and logo, belongs to us and our licensors. We give you a personal, non-exclusive, non-transferable right to use it under these terms. If you send us feedback, we may use it without owing you anything.

11. Copyright complaints

If you believe content on Atomics infringes your copyright, email support@atomics.app with the following:

  • the work;
  • where the infringing content is (its link);
  • your contact details;
  • a statement that you have a good-faith belief the use is not authorized;
  • a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for them;
  • your signature.

We respond to valid notices as the Digital Millennium Copyright Act (DMCA) provides, and we disable the accounts of repeat infringers.

12. Suspension and termination

You can delete your account at any time from the Account page. We may suspend or close your account, or remove content, if you seriously or repeatedly break these terms, if the law requires it, or to protect other users or the Service. Where it is reasonable and lawful, we will tell you why and give you a chance to export your content first. If we discontinue the Service, we will give you at least 30 days' notice and a way to export your content, and we will refund any prepaid, unused period. Sections 2 (last sentence), 7, and 9 through 14 survive termination.

13. Disclaimers

Local spaces live only in your browser. If your browser storage is cleared or your device is lost, they are gone unless you exported them. Keep your own backups of anything important. Except as these terms say otherwise, the Service is provided "as is" and "as available". To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted or error-free.

14. Limitation of liability

To the extent the law allows, neither party is liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US $100. These limits do not apply to liability that cannot be limited by law, such as for fraud, gross negligence or willful misconduct.

15. Indemnity

If a third party makes a claim against us because of Your Content or your breach of these terms, you will cover our reasonable costs and losses arising from it. This includes reasonable legal fees.

16. Governing law and disputes

These terms are governed by the laws of the State of New Jersey and applicable US federal law, without regard to conflict-of-laws rules. Before filing a claim, please email us so we can try to resolve it informally within 30 days. Either party may bring a claim in small claims court. Otherwise, disputes will be heard in the state or federal courts located in Mercer County, New Jersey, and both parties consent to their jurisdiction. If you are a consumer in a country that gives you the right to bring claims in your local courts or under your local law, nothing here takes that away.

17. Changes to these terms

We may update these terms. For material changes, we will tell you by email or in Atomics at least 30 days before they take effect, unless the change is required by law or addresses a security issue. If you keep using Atomics after the changes take effect, the new terms apply. If you do not agree, you can stop using Atomics and delete your account.

18. General

These terms, the Privacy Policy, and any order you sign with us are the whole agreement between us about the Service. If part of these terms cannot be enforced, the rest still applies. Our not enforcing a term is not a waiver of it. You may not transfer these terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets. We communicate with you electronically, and those communications satisfy any requirement that they be in writing.
